Man Convicted in Fatal Baseball Bat Attack

ORLANDO, FLA. -- A central Florida man was convicted Friday in the fatal beating of an elderly man in the community of Bithlo.

An Orange County jury found Robert Pascale guilty of first degree murder in the case, according to court documents.

Testimony and police records indicated that Pascale and his co-defendant, Michael Garay, beat an elderly man to death with a baseball bat in the mistaken belief that he was a child molester.

The victim, 78-year-old Hugh Edwards, only had the misfortune to look like someone the two men thought was a pedophile. It was a fatal case of mistaken identity.

Authorities said Edwards was beaten to death with a baseball bat.

Garay has already been tried in the case, and found guilty. He was sentenced to life in prison.

Garay's attorney claims that his client had acted in fear of Pascale, and did not deliver the fatal blow.

Pascale's attorney has claimed almost the opposite, saying Garay did most of the beating ... including delivering the fatal blow.

There has been no immediate word on when Pascale will face sentencing.
