PORT ORANGE, FLA. -- Authorities in Port Orange reported finding human remains in the back yard of a man accused in the rape of a child.

According to detectives, James Maxwell, 43, was accused of kidnapping a girl, 9, from a party, raping her, and releasing her afterward.

Police said Maxwell was arrested shortly after the alleged attack and has been held without bond ever since.

Detectives said they had received information last week that Maxwell may have been involved in at least one other crime, and that prompted the search of his back yard.

According to the police, this investigation was not related to the alleged rape.

Officials said the body they discovered was that of an adult, and was decomposed to such a degree that it will probably take a month for investigators to make a positive identification.

An autopsy is being conducted to verify the cause of death.

Authorities said that Maxwell's girlfriend and their child lived with him in the house, but they made it clear that she is not a suspect in whatever may have taken place.
